These Terms of Service govern your access to and use of Bizappbuild's website, products, and services. By using our services you accept these terms. Bizappbuild focuses on delivering business software development solutions tailored for companies operating in Thailand. Use of our platform, tools, and delivered software is subject to these terms, applicable laws, and any separate agreements for paid services.

1Eligibility

To use Bizappbuild services you must be authorized to enter into legal agreements in your jurisdiction and be at least the minimum age required by local law for contracting business services. Individuals or entities operating under applicable corporate or commercial registration are eligible to engage our development services.

Users must meet the minimum legal age or have the authority to represent a business entity. If you are under the requisite age, you may use the services only with consent from a legally authorized representative able to enter contracts on your behalf.

You agree to use Bizappbuild services lawfully and only for legitimate business purposes. Prohibited uses include unauthorized access to systems, distribution of harmful software, infringing activities, or any use that contravenes applicable laws in Thailand or other jurisdictions.

Some services or features may be restricted by export control or local regulations. Bizappbuild may limit access to certain functionalities based on your country of residence or the nature of the project to comply with legal obligations.

2Account and Access

Creating an account or contracting services binds you to these terms and any project-specific statements of work. Accurate account information enables efficient project delivery and support.

You are responsible for keeping account and contact information current. Bizappbuild relies on accurate details to provide project updates, invoices, and security notifications.

Protect account credentials and immediately notify Bizappbuild of any suspected unauthorized access. We recommend strong passwords and secure handling of access credentials related to development and deployment environments.

Accounts and associated rights are not transferable without Bizappbuild's express written consent. Assignment or transfer may require updated contractual arrangements.

If you suspect your account is compromised, contact support immediately. Bizappbuild may suspend access or take protective measures while contribute security incidents to reduce risk to your data and other users.

Bizappbuild may suspend or restrict account access for suspected breaches, nonpayment, or activities that threaten platform integrity. Suspension may be temporary while issues are resolved.

3Services

Bizappbuild provides business software development services including custom application development, system integrations, API development, maintenance, and consultancy. Service scope and deliverables are defined in project proposals and statements of work agreed with clients.

Service features, tools, and availability may be updated as technologies evolve. Bizappbuild will communicate significant changes that materially affect active projects and collaborate on transition plans where needed.

We strive for reliable service delivery but certain factors like third-party dependencies, infrastructure issues, or force majeure events may affect availability. Project timelines reflect realistic estimates and are managed through regular client communication.

4Usage Rules

When using Bizappbuild services, you agree to follow reasonable usage rules designed to protect the platform and other clients. Violations can result in restrictions or termination.

  • Do not attempt to bypass security controls or access data you are not authorized to view.
  • Do not upload malware, phishing content, or other harmful code to Bizappbuild environments.
  • Comply with acceptable use policies for integrations and third-party services used in projects.
  • Do not attempt to disrupt service availability or perform denial-of-service actions.
  • Respect intellectual property rights and avoid sharing unlicensed content through our systems.
  • Provide accurate information during onboarding to ensure proper project scoping and delivery.
  • Cooperate with reasonable requests from Bizappbuild for project approvals, testing, and deployment.

5User Content

User content consists of any data, materials, or information you provide to Bizappbuild for use in delivering services. You retain ownership of your content subject to the license granted below.

You retain rights in the content you supply to Bizappbuild, including data and proprietary business materials. You warrant that you have the rights necessary to provide such content for use in the project.

By providing content to Bizappbuild, you grant us a non-exclusive, worldwide license to use, reproduce, and process that content solely for the purposes of performing the contracted services and improving service delivery for your project.

You are responsible for ensuring user content does not violate laws or third-party rights. Bizappbuild may refuse or remove content that appears unlawful, malicious, or contrary to contractual obligations.

Upon contract termination or at your request, Bizappbuild will return or securely delete user content according to agreed retention schedules, except where retention is required by law or for legitimate business recordkeeping.

6Intellectual Property

Bizappbuild retains intellectual property rights in pre-existing tools, frameworks, templates, and methodologies used to deliver services. Project deliverables and newly developed software rights are allocated as specified in the project agreement.

  • Do not copy, resell, or redistribute Bizappbuild proprietary software or tools without authorization.
  • Client-provided activity and brand assets remain the client's property and are used only per project requirements.
  • When rights to deliverables are transferred, they are provided subject to any third-party license terms embedded in those deliverables.

7Paid Services

Paid services include custom development, managed services, subscriptions, and consulting. Specific pricing, billing cycles, and deliverables will be detailed in proposals and invoices.

Pricing for paid services is set in client proposals and may include fixed fees, time-and-materials, or subscription charges. Estimates are based on project scope and may be revised if scope changes occur.

Invoices are payable according to the terms specified in the project agreement. Accepted payment methods will be outlined in invoices. Late payments may result in service suspension or additional fees as specified in the contract.

Subscription services renew per the agreed billing cycle. Cancellation terms and notice periods are specified in subscription agreements and in project documentation.

Refunds, if any, will be handled in accordance with the project agreement and applicable consumer protection laws. Refunds are considered on a case-by-case basis and limited to amounts prepaid for unused services.

Clients may cancel services according to notice periods in the agreement. Cancellation may trigger final invoices for work completed and any reasonable wind-down costs associated with termination.

Clients are responsible for applicable taxes, duties, or levies associated with services. Bizappbuild will itemize taxes on invoices where applicable under local Thai tax regulations.

Bizappbuild may update pricing for future services with notice. Existing contracts remain governed by their agreed pricing unless mutually amended in writing.

Failure to pay can result in halted work, suspension of deliverables, and collection actions. Bizappbuild may withhold source code, access, or other deliverables until outstanding amounts are settled.

8Disclaimer

Bizappbuild provides services and information on an as-is basis. While we design solutions to be reliable and useful for business operations, outcomes depend on many factors including client inputs, third-party services, and operational context. Clients accept responsibility for decisions made based on delivered systems.

9Limitation of Liability

To the fullest extent permitted by law, Bizappbuild's liability for direct damages arising from our services is limited to amounts paid by the client for the specific services that gave rise to the claim during the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages caused by project outcomes or third-party actions.

10Third-Party Services

Third-party products, integrations, or services used in a project are subject to their own terms and privacy policies. Bizappbuild coordinates integrations but is not responsible for third-party availability, performance, or pricing.

11Termination

Either party may terminate services as set out in the project agreement for material breach, insolvency, or failure to cure specified defaults. Termination procedures, data return, and final compensation are governed by the relevant contract terms.

Upon termination, outstanding fees for work performed become due. Bizappbuild will provide reasonable assistance for transition or handover of project materials, subject to payment of outstanding amounts and agreed handover fees.

12Privacy

Handling of personal data is governed by our Privacy Policy. Bizappbuild processes personal information necessary to provide services, manage accounts, and comply with legal obligations. Privacy details and user rights are set out in the privacy documentation.

13Communications

Bizappbuild may communicate by email, phone, or other channels for project coordination, billing, and service notices. Clients should ensure contact details are accurate and monitor communications for important project updates.

14Changes to Terms

Bizappbuild may update these Terms of Service to reflect changes in our services or legal requirements. Material changes will be communicated in advance to affected clients, and continued use after changes indicates acceptance.

15Governing Law

These terms are governed by the laws applicable in Thailand. Parties will seek to resolve disputes by negotiation and, where necessary, through the dispute resolution mechanisms specified in the agreement or local courts as appropriate.

16Dispute Resolution

If a dispute arises, parties should attempt to resolve it through good faith discussions. If unresolved, disputes may be escalated to mediation or adjudicated in the jurisdiction stipulated in the project contract, typically within Thailand.
